These terms and conditions (“Terms”) govern your use of the KMA Concrete Constructions website at www.kmaconcreteconstructions.com.au (“the website”). By accessing or using the website you agree to these Terms.

These Terms cover the website only

Any concreting work we perform for you is governed by a separate written quote and contract — and, for residential building work in NSW valued over $5,000, by a written contract that complies with the Home Building Act 1989 (NSW). Nothing in these Terms forms part of, or changes, any contract for works.

Information on the website is general

The content of the website is general information about us and our services. It is not professional, engineering or construction advice, and it does not take the conditions of your site into account. Always get a site-specific assessment and a written quote before making decisions about concreting work.

We take reasonable care in preparing the content but, to the maximum extent permitted by law, we do not warrant that it is complete, current or error-free, and we may change it at any time without notice.

Quotes, pricing and project examples

Any prices, project examples or photographs on the website are indicative only and are not an offer. Quotes are prepared in writing, normally after a site inspection, and are subject to site conditions and the details set out in the quote itself.

Your use of the website

You agree to use the website lawfully, and not to:

• interfere with its operation or security, or introduce malicious code;
• scrape, harvest or bulk-copy its content or data;
• submit false or misleading enquiries; or
• use it for spam or any other unlawful purpose.

We may restrict or block access to the website where reasonably necessary to protect it or its users.

Unless noted otherwise, the content of the website — text, photographs, graphics and logos — is owned by or licensed to KMA Concrete Constructions Pty Ltd and is protected under the Copyright Act 1968 (Cth). Nothing in these Terms limits your rights under the Copyright Act’s fair dealing provisions. Third-party content, such as the embedded Google Map, remains the property of its owners.

The website links to third-party sites and services, including our Facebook and Instagram profiles and an embedded Google Map. Our enquiry form is protected by Google reCAPTCHA, whose use is subject to the Google Privacy Policy and Terms of Service. Links are provided for convenience — to the extent permitted by law, we do not endorse and are not responsible for third-party sites, their content or their practices.

Your consumer rights and our liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law — including that services will be provided with due care and skill, be fit for their purpose and be supplied within a reasonable time. For residential building work in NSW, our services also come with the statutory warranties in section 18B of the Home Building Act 1989 (NSW).

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy you have under the Australian Consumer Law, the Home Building Act 1989 (NSW) or any other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law, we are not liable for loss arising from your use of, or inability to use, the website; from reliance on its content without obtaining a site-specific assessment and written quote; or from third-party websites and services.

Privacy

Personal information you submit through the website is handled in accordance with our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time by posting the amended version on this page with a new “Last updated” date. Changes apply from the date they are posted, and using the website after that date means you accept the updated Terms.

Severability and governing law

If any part of these Terms is void or unenforceable, it is severed and the rest remains in force. These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
